Got A Speeding Ticket!

What a great way to start the day!

Does anyone know if points transfer from state to state. I'm in Michigan now, but my residence and license are Ohio. If I just decide to pay it, will the points transfer over, and will my insurance company find out?

He claims I was going 43 in a 25. He cited me for 35 but wrote the actual (43) in the remarks area. He used radar.

What should I do?

I dunno what to do....

We do not have any points here in Louisiana...the insurance just checks our records every 3 years.,...

If you were speeding then take your punishment.....and pay the fine....or try to contest and see if he shows up...he may not since you have out of state license....

Never admit guilt!
Ask to see the certification of the radar gun. The individual serial number of the gun should be on the ticket.
Also, ask to see the radar calibration log. There should be documentation on when the last time to gun was calibrated. Also ask the department to provide records of the officer's radar qualification. Is it current? What were the traffic conditions at the time the reading was taken? Where there other vehicles near you? At what distance from you was the reading taken? (You are trying to establish doubt that it was your speed the officer recorded)
If all else fails ask the judge to note your good driving record and that you were aware of your speed but you DID NOT BELIEVE THAT IT WAS DANGEROUS GIVEN THE ROAD CONDTIONS THAT EXISTED AT THE TIME.

I called the courthouse, and they don't have them?

So do I request a court date, then colect the documents, and then try to get it suspended?

Request them during court. You're trying to establish that the radar unit provided an incorrect reading or at the very least that you were not traveling at that speed. The police dept will have to provide the records. The case will either get continued, or most likely, dropped if you make them go through too much time and effort to try and prove you guilty.
Above all, your speed was NOT excessive and did not present a danger to yourself and others.

Back when I used go on weekend trips across the country, I had a book that told me what kind of police units the states used, frequencies, whether or not state had compacts with other states, ect....

I have a good Bell radar detector. ?They're basically useless now, because the cops are just keeping the guns cool, then flip it on and fire at you. ?A warning flashing 9-9-9-9, does not help...

I've never done this before. ?So I should request a court date, then ask for those documents? ?I shouldn't go to the station beforehand. ?
I'm also a little worried cause I'm only being charged with 35mph and he wrote the actual 43mph in the remarks section. ?Can't that come back and screw me worse?

Sorry to hear you got a speeding ticket.

My experience is that if you did not have to post a bond, then the state that you are from has a compact with the state where you were ticked. This insures that you will have to resolve the ticket or your home state will hold your feet to the fire.

In fact Michigan and Ohio are part of the compact. The bad news is that if you do't take care of the ticket in Michigan then Ohio will suspend your driving privileges and you will have to pay a reinstatement fee, in addition to any fine, to get your driving privileges restored.

The good news is that Ohio does not assess points, for out of state speeding violations for sure, nor do they report out of state speeding violations to your insurance company to the best of my knowledge.

Ten miles over is a minimum violation and if you are humble, you could get by with just court costs and maybe a minimum fine. If you hold their feet to the fire, you could get burned. The choice is yours. Hope this helps.

Well the time has come...

Tomorrow is the big day in court.

The plan is to plea to get it put "under abayance" or suspension. Which means I'll pay the fine, but the points will be held for like 3 or 6 months, and as long as I don't get any other tickets, they'll dissapear.

zimm...I don't know how those states work...but I know when I used to get tickets out of state in NC....it would catch up to me sooner or later.....it would take longer for NJ to find out about it...be nonetheless they would show up.....

Yeah, I guess MI & OH are in this pact of exchanging point info. That's why I'm going through with all of this.
But the "under abayance" or suspension thing doesn't apply any points unless you get another ticket within 3 or 6 months.

Good news!!!

I pleaded my case straight up. I didn't try requesting all those radar forms & officers certification. I just stated that no where else in Flint is there a 4-lane road with a 25mph limit. That combined with a good looking gentleman like myself sporting a Tommy Hillfinger suit, and the Judge suspended it. No fines or anything. He said something to the extent that he sees a lot worse looking characters involved in worse crimes getting off everyday. (Note - I'm this was in Flint MI court, not a very nice town)

So all is well.

I was considering the spoiler a while back, but have decided to save for an all out mod! Rancho kit, rims & tires will hopefully be in the near future.
Still in discussions over the new job though...
