Got Cheated Into A Ticket

ok so here is the story, so i had to leave texas a few days early cause i had the chance of getting stuck until wed. so i got to the airport... picked up my truck and drove home. so i'm heading down my home street (speed limit is 25) i'm doing about 31-32mph. and there is a right angle turn... i mean this thing is sharp, posted speed limit for the turn is 15mph. i go around the turn at 20... bam there is a cop car (sitting 2 houses down from mine) no big deal... wait i guess it is cause as i pull into my drive way here comes mister cop. he gets out... and tells me i'm getting a ticket for not having a front lisence plate (you know... the one that fell off during wild west) no big deal... i tell him the story and show him the plate (it was in the windshield) so he takes my lisence and does his thing... when he gets back i sign the ticket and he walks away.

wait a second... the ticket isn't for my lisence plate... it's a SPEEDING TICKET... to set me off it says i was doing 39MPH!!! :8: :7: :8: :8: :7:

oh now i know that no matter how hard you try you could never get this big truck around that turn at 40 mph! just no way! at 25 you squeal the tires... in my brothers sports car you can't go a dime over 30. come on... just no way, so as i go back to the cop car to have a word with him... guess what? he drives away... but by the time i jumped in my dads car he was gone.

so tell me i did not just get cheated into a bad bad speeding ticket. :6:

the worse part is... i'm the one who called the city and got all the sigitures to have those cops put in on my street... because of all the guys doing burnouts up and down my street. :6: i feel bad... and very cheated.

what do you think? :cry:

Man, bad deal. What can I say? Pay the man, you have no choice now, and write it up to experience.

WOW - I couldn't of said it any better - given the angle and it sounds like the AV couldn't do that corner that fast, I would fight it.

thats just what i'm doing... best thing going for me... is i just tried it out... when you come around the first corner at 25 and hamer down all the way down my street you only hit 38 mph... and thats if you go around the first corner 5 mph over the posted sign... i tried it again starting at 20... i got to 35-36, but you still have to slow down for that 15 mph turn. i really do think he tricked me... cause not once did he say it was a speeding ticket. the bad part is i'm mad at myself... but it's not like i did anything wrong. and ever still there is nothing i can do about it. I go to court september 11th... and i'll have my word then.

i think i forgot to add the point,

i don't hammer down my own streets... so there is no way i was going 40 befor or through that turn. or should i say 39 to make it sound better (like he did)

I'm sending this quote to court for you. Since you tried it, you indeed broke the law albeit after the fact. >:D Just kidding, I hope you win! That's totally rediculous!! :B:

You go just far enough away that your neighbors and parents can't hear you, right? >:D Now how could I know that? >:D
 
Bigred, based on your recent posts, thank goodness for bad luck -- if you didn't have back luck you wouldn't have any luck at all. ;)

In addition to the advice given by others, it probably wouldn't hurt to file for a change of venue if you're going to fight the ticket. Not that you need it, bit it could help your chances and be more fair if you go to a different court than the police officer normally goes to.

And hold off on buying any lotto tickets in the near future. :)
 
If your driving record has ANY blemishes on it at all, don't try to fight it by yourself. You'll lose, and most likely draw the attention of the court more than if you just paid the fine.

Hire a lawyer. Good traffic lawyers can get just about any ticket reduced to "faulty equipment". Nothing on your driving record. Your insurance company won't even know you got the ticket in the first place.

I am not a lawyer, nor do I play one on TV. I just got tired of counting points on my license and hired a lawyer once. It isn't cheap, but neither is high risk insurance.
 
wow.. thank you everybody! you all have brought up points that are very good and very useful. i just finished taking photos of the area... and a sky map of the area is printed and marked. i go into court not the 11th but the 30th now (just found out) so once i settle my first case i will ask a few questions maybe get on the judges good side. but i got alot of work now... plus i got school starting in a few days and i have to find over 200 dollars so i can replace my fog lamps... :6: i guess you won't be seeing many upbeat post from me anytime soon. maybe in 5 more when i hit deity, but thats about it. thanks for your guys help again. i need alot. my brother is going to help me with the case but getting it ready is going to suck.

and if anybody is wondering about my 30th court case... it's another "ha i got you, you stupid dumb kid driving a nice car" i guess my clock in my truck was 4 minutes slow... cause you bet ya, driving in the diamond lane (2 people or more at certain hours only lane) and see it opens at 3:00 cop put down 3:02.... sucks huh? plus i had already merged off the free way befor he pulled me over. i guess i don't get many breaks huh? but i'm forsure that i'm going to win that one.

You'd said that Occifer Bob originally cited you for no front license plate...is that on the ticket? If it is, you should have that covered by having your plate in the windshield (fuzzy on CA laws, but that seems to be true here in WA).

You'd be best served making sure your photos and street layouts are well presented. Stick to facts. Forget about the calibration of the radar and the officer's latest certification. Seems to be the growing trend that the officer's comments on the ticket are his sworn testimony, therefore the officer need not show up in court to personally hang you. Teenagers almost always lose the automatic credibility award when compared to cops.

Also, your demeanor is very important, although with THIRTY court cases under your belt you're probably well aware of that. I've found the genuine 'scared poopless' approach yields the best results for young teens. And bring your mom/dad. Judges like that stuff and lots of "yessirs" too.

Just a little advice from the cop's daughter (only thing worse is the preacher's daughter ;D )

I think you need to call the police station and ask to speak with that officers supervisor or the internal affairs div. On the other hand you could do what some of my friends do and contribute 25,000.00 grand to the police chief's or sheriff's re-election fund ;D I would tell the supervisor I know that cops lie all the time but I don't like when they lie to me. There are some good honest cops out there who want to do the right thing but on the other hand there are some out there I would not trust leaving my dog with. I this day and age I even teach my kids not to fully trust anyone they don't know that includes cops. Well enough ranting :8: Good luck in court

Take it to court. Do not go unprepared. Did he say it was with a gun? When was the last time it wass calabrated? When was the last time he qualified with it?
 
In Calif there is one additional factor with radar. ?The roadway has to have been surveyed for radar in the last 5 years. Depending on the court the officer must bring in the survey or the court will have the info on the survey. Ask the officer when the survey was done AND what the speed of the survey recommended for the street. The survey speed MUST be posted the same. I have seen a few streets where the survey speed and the posted speed are different.

In order to beat a ticket you must be prepaired to cross examine the officer. Write a list of questions and follow your list. Most people who fight a ticket do not cross examine the officer, ?they just want to tell the court why the ticket is incorrect. if you dont cross examine you do not have much of a chance to win. The officer should testify as a standard line with out your asking. 1. that the unit was calibrated and how he checked it. 2. the survey of the roadway and have back up documents . 3. I would always testify that I visually estimated the speed of the target vehicle and use the radar to verify my visual estimation. (I can visual estimate within 2 mph) so can you with some practice.

As far as the front plate goes that is a fix it ticket. Calif still requires 2 license plates, (5200CVC) having the plate in the cab will not cut it. Just put the plate on and then remove it later if you don't want it on the car.
 
There are a lot of red light and speed cameras in California. Not having a front tag, means no ticket. Getting a fix it ticket is about the same as getting hit by lightning on a clear summer day.
The police seem not to enforce the part of the vehicle code governing expired tags, much less no front plate. You were just unlucky.

well i must be really unlucky then... when i got my 67 camaro i had it about a month when i got written up for no front plate. the guy i bought it from didn't have it... so off came the original black and yellow plate, on went the new plates. needless to say i was pretty pi$$ed :8:.

Big Red, Sorry to hear about your problem, but all is not lost.
Signing your ticket is not an admission of guilt. It merely is proof that you received the summons. If you feel you were falsley charged, take it to the judge. It sounds to me like you got a bum deal.
